An employer can prevent an employee from competing so long the employer is doing to protect legitimate interest.

In Georgia, as an employer, you can prevent an employee(s) from competing with your business so long the agreement(s) are narrowly tailored to protect your legitimate business interest(s). Your legitimate business interest(s) is/are defined as protecting customer relationships, protecting confidential business information, and/or trade secrets. They must be reasonable and reasonableness depends on the employer’s business. For example, you can prevent your employee from disclosing or using identifiable information about source(s) of supplies if that information provides an advantage to its competitors. Thus, it is important to review these agreements in their entirety with an attorney to determine if these clauses, which are known as non-compete agreements would be enforceable in Georgia before signing those agreements.
